The U.S. House of Representatives Committee on the Judiciary is conducting oversight of the New York County District Attorney’s unprecedented indictment of a former President of the United States and currently declared candidate Donald J. Trump.

Republican Representative Jim Jordan (R-OH), the committee’s chairman, has issued a subpoena to Mark Pomerantz, the former New York County Special Assistant District Attorney leading the investigation into the former president’s finances, according to a letter from Rep. Jordan to Pomerantz.

The subpoena comes after Pomerantz refused to voluntarily cooperate with the committee’s oversight request.

In a letter dated March 27, 2023, Pomerantz cited the New York County District Attorney’s Office’s instruction not to cooperate, Jordan’s letter explains.

Jordan believes that Pomerantz’s testimony and relevant documents are “necessary to inform the Committee’s oversight and potential legislative reforms.”

The representative states that Congress has a “broad and indispensable” power to conduct oversight, which “encompasses inquiries into the administration of existing laws, studies of proposed laws, and surveys in our social, economic or political system for the purpose of enabling Congress to remedy them.”

He also notes that Congress has a specific and important interest in preventing politically motivated prosecutions of current and former presidents by elected state and local prosecutors, especially in jurisdictions where prosecutors are popularly elected and trial-level judges lack life tenure.

Former President Trump’s recent indictment and the New York County District Attorney’s Office’s investigation into his finances have raised concerns about politically motivated prosecutions of current and former presidents.

Jordan writes that “if state or local prosecutors are able to engage in politically motivated prosecutions of Presidents of the United States (current or former) for personal acts, this could have a profound impact on how Presidents choose to exercise their powers while in office.”

Jordan also cites potential legislative reforms, including broadening the existing statutory right of removal of certain criminal cases from state court to federal court, enhancing reporting requirements concerning the use of federal forfeiture funds, or prohibiting the use of federal forfeiture funds to investigate a current or former president or presidential candidate.

Jordan highlights Pomerantz’s unique role in leading the investigation into the former president’s finances and his ability to provide information necessary for the Committee’s oversight and potential legislative reforms.

Despite the New York County District Attorney’s Office’s directive not to cooperate, Pomerantz has already discussed many relevant topics in his book and public interviews.

Jordan argues that Pomerantz has “no basis to decline to testify about matters before the Committee that you have already discussed in your book and/or on a prime-time television program with an audience in the millions.”

Jordan also cites Pomerantz’s book, “People vs. Donald Trump: An Inside Account,” which he describes as a “300-page exercise in score-settling and scorn” and reveals the extent to which the New York County District Attorney’s Office’s investigation of President Trump appears to have been politically motivated.

Jordan writes that “these perceptions appear to have colored your work as a special assistant district attorney, to the point that you even resigned because the investigation into President Trump was not proceeding fast enough for your liking.”

The Ohio representative concludes his letter by stating, “for these reasons, and in light of your disregard of our earlier voluntary request, please find attached a subpoena compelling your appearance for a deposition.”

The subpoena represents the committee’s continued efforts to investigate the potential for politically motivated prosecutions of current and former presidents and to consider legislative reforms that would prevent such actions in the future.
