The federal judiciary continues to show its impatience with Hillary Clinton and the State Department she once led. On Thursday Judge Emmet Sullivan ordered State to begin coordinating with the FBI to retrieve Mrs. Clinton’s records in response to a Freedom of Information Act request from Judicial Watch.

Weren’t they already doing that, you might ask? Apparently not. State admitted in Thursday’s legal hearing that it had made no such effort to retrieve the records from Mrs. Clinton’s private email server and the thumb drives that she and her lawyer recently and reluctantly turned over to the FBI.

Among other tart observations, Judge Sullivan noted that “we wouldn’t be here today if the employee had followed government policy.” That employee was Secretary of State Clinton, who chose to ignore federal policy and run her official communications through her personal account. State has now confirmed in its legal filing that Mrs. Clinton did not even use a state.gov email account.

Mrs. Clinton must be worried that the email affair is damaging her presidential campaign because she dared to answer questions from reporters on Tuesday and claimed that “I did not send classified material and I did not receive any material that was marked or designated classified.”

But we already know government secrets did cross her email account in violation of the law for handling those secrets, thanks to her decision to use a personal server. The question now is whether the FBI will follow the logic of the law and hold her accountable the way it has so many others.
